ItalianoTerms and Conditions of Sale
These Terms and Conditions of Sale (“Terms”) govern the purchase of products through the website soloessenze.com, operated by SCIMONELLI MICHAEL OMAR (hereinafter “Soloessenze” or the “Seller”), with registered office at Bivio Ramata s.n.c. (no street number), 94015 Piazza Armerina (EN), Italy – VAT no.: 01889350854.
Purchasing products on the site implies full acceptance of these Terms and Conditions. The provisions of Legislative Decree 206/2005 (Italian Consumer Code), Legislative Decree 70/2003 (e-commerce) and Regulation (EU) 2016/679 (GDPR) apply.
1. Contracting Parties
The sales contract is concluded between Soloessenze and the customer (hereinafter the “Consumer” or “Customer”), a natural or legal person who makes a purchase on the site. These Terms apply both to consumers (pursuant to Legislative Decree 206/2005) and to business customers.
2. Products and Availability
The products offered for sale are described in their respective product pages. Soloessenze reserves the right to modify the available range at any time. If an ordered product is out of stock, the Customer will be promptly informed and may choose between a full refund or a replacement product.
3. Prices
All prices shown on the site are in Euro (€) and include VAT. Soloessenze reserves the right to change prices at any time; the price applied will be the one shown at the time the order is confirmed.
4. Orders and Conclusion of the Contract
The order placed by the Customer constitutes a contractual proposal. The contract is concluded when Soloessenze sends the order confirmation email. Soloessenze reserves the right not to accept orders in the event of product unavailability, incorrect data or suspected fraud.
5. Payments
Accepted payment methods are those shown at checkout (credit/debit cards, PayPal, etc.). Payment is required in full before shipment. Soloessenze does not store payment card data; transactions are handled by PCI-DSS certified providers.
6. Shipping and Delivery
Shipments are made to Italy and, unless otherwise stated, to selected countries. Shipping times and costs are indicated on the Shipping Information page. The risk of loss or damage to the product passes to the Customer upon delivery.
7. Right of Withdrawal (Legislative Decree 206/2005, art. 52-58)
The Consumer has the right to withdraw from the contract within 14 days of receiving the products, without giving any reason. To exercise the right of withdrawal, the Customer must notify Soloessenze by email at info@soloessenze.com or through the withdrawal form available on the site, before the deadline expires. The product must be returned in the same condition in which it was received. Return shipping costs are borne by the Customer, unless otherwise stated. Soloessenze will refund the total amount paid, including original shipping costs, within 14 days of receiving the returned product. The right of withdrawal does not apply to sealed products that are not suitable for return for hygiene reasons and that have been opened after delivery (art. 59, letter e), Legislative Decree 206/2005).
8. Legal Guarantee of Conformity
Pursuant to art. 128-135 of Legislative Decree 206/2005, the products sold are covered by the legal guarantee of conformity for 2 years from delivery. In the event of a lack of conformity, the Consumer is entitled to repair, replacement, price reduction or termination of the contract.
9. Liability
Soloessenze is not liable for indirect or consequential damages arising from the use of the products. Soloessenze’s maximum liability is limited to the value of the order. Soloessenze is not liable for delays or non-performance due to force majeure.
10. Dispute Resolution
The parties shall attempt to amicably resolve any dispute. Failing resolution, disputes shall be referred to the competent court of the Consumer’s place of residence or domicile, pursuant to Legislative Decree 206/2005, art. 66-bis. For alternative dispute resolution (ADR/ODR), the Consumer may access the European platform: https://ec.europa.eu/consumers/odr.
11. Governing Law
These Terms and Conditions are governed by Italian law. For anything not expressly provided for herein, the provisions of the Italian Civil Code, Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 apply.
12. Changes
Soloessenze reserves the right to modify these Terms and Conditions at any time. Changes take effect from the date of publication on the site. Orders placed before the changes are governed by the terms in force at the time of the order.
